These Terms of Service ("Terms") govern your use of Photis ("the app"), operated by SealAI, a sole proprietorship based in California ("we," "our," or "us"). By downloading or using Photis, you agree to these Terms. If you do not agree, do not use the app.
We grant you a limited, non-exclusive, non-transferable license to use Photis on your personal iOS device for personal, non-commercial purposes.
You agree not to:
— Reverse engineer, decompile, or attempt to extract the source code of the app
— Use the app for any unlawful purpose or in violation of any applicable laws
— Attempt to gain unauthorized access to any part of the app or its infrastructure
— Use the app in any way that could damage, disable, or impair its operation
You own the journal entries and content you create in Photis. By using the app, you grant us a limited license to process your content solely for the purpose of providing the app's features — including AI analysis, cloud sync, and personalized prompts. We do not claim ownership of your content and do not use it for any other purpose.
You are responsible for the content you create. You agree not to use the app to store or transmit content that is unlawful, harmful, or infringes on the rights of others.
Photis uses third-party services to operate, including OpenAI (for AI analysis and prompt generation) and Supabase (for cloud storage). Your use of the app is subject to these providers' terms and policies. We are not responsible for the practices of third-party services.
When you use voice input or save journal entries, the content may be sent to OpenAI's API for processing. OpenAI's API data usage policy applies to that processing.
If you choose to connect Apple Health, Photis reads health and fitness data from HealthKit solely to provide the app's health correlation features. We do not use HealthKit data for advertising or share it with third parties. HealthKit data is stored locally on your device only.
Photis is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
Photis is not a medical app. The health correlations and insights surfaced by the app are for informational and reflective purposes only. They are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical concerns.
To the fullest extent permitted by applicable law, SealAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for the app in the twelve months preceding the claim.
We reserve the right to suspend or terminate your access to Photis at any time if you violate these Terms. You may stop using the app at any time. Upon termination, your license to use the app ends. You may delete your account and all associated data at any time from Settings → Delete Account.
We may update these Terms from time to time. We will update the "last updated" date at the top of this page and, for significant changes, notify you within the app. Continued use of Photis after changes are posted constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of California.
